A New York man will not face any charges for allegedly killing an unborn baby as well as his pregnant girlfriend last week in a gristly murder case.
Anthony Hobson, 48, of Rego Park, is charged with murder in the death of Jennifer Irigoyen, 35, who was five months pregnant, the New York Post reports. Police said he targeted Irigoyen’s torso, possibly in a direct attempt to kill her unborn child; but he will not be charged for the baby’s death.
The law that Gov. Andrew Cuomo signed in January repealed all criminal penalties for abortions, as well as the state fetal homicide law. The radical new pro-abortion law does not just expand late-term abortions, it also denies justice to crime victims such as Irigoyen and her unborn child.
Initially, Queens District Attorney Richard Brown said Hobson also would be charged with second-degree abortion in the death of Irigoyen’s unborn baby. However, a spokeswoman later told the Post that Hobson will not face the abortion charge because it “was repealed by the legislature.”
“A woman was brutally stabbed — killing her and the unborn child,” Brown said in a statement. “The defendant is alleged to have shown no mercy and no regard for human life when he repeatedly and purposely plunged a knife into this expectant mother’s abdomen, torso and neck.”
Police said Hobson, Irigoyen’s boyfriend, turned himself in last week, and now faces charges of second-degree murder, tampering with evidence and fourth-degree criminal possession of a weapon.
Hobson is accused of dragging Irigoyen out of her Queens apartment and brutally stabbing her to death. Police said someone called 911 after finding Irigoyen bleeding heavily in the vestibule of an apartment building on Myrtle Avenue early Feb. 3.
A neighbor reportedly heard Irigoyen yell, “He’s got a knife! He’s going to kill the baby!” around 1 a.m. Feb. 3 around the time of the attack.

Police said the woman had multiple stab wounds on her torso, neck and hands; she was transported to the hospital where she was pronounced dead shortly afterward. According to authorities, she was about five months pregnant with her unborn baby, who also died as a result of the attack.
It appears that her unborn baby may have been targeted directly, but that does not matter under the new state law. Before birth, there are no longer any consequences for killing a baby in New York.
Reacting to the tragedy, state Assemblywoman Nicole Malliotakis told CBN News: “As I said in my floor speech, being assaulted (or in this case murdered) and losing your baby is not ‘a woman’s choice.’ It’s been only two weeks and we already see the first victim of a poorly crafted law.”
In January, Gov. Cuomo signed the pro-abortion law, which expands late-term abortions, repeals the state fetal homicide law and removes abortion from the criminal code. Later, he celebrated the law by having state landmarks lit in pink.
New York is not alone. Rhode Island Gov. Gina Raimondo is backing a similar bill to expand late-term abortions and repeal the fetal homicide law in her state. These states are not protecting women’s rights by urging the repeal of such laws. They are allowing criminals to get away with fewer consequences for attacking a pregnant woman and her unborn child.
