Pope Leo must not contradict the past Magisterial by confusing what is invisible (LG 16) as being visible to produce a liberal and non traditional conclusion and then threaten the SSPX with excommunication if they do not accept it. This is secular and dishonest coercion.
With the rational and so traditional interpretation of Vatican Council II, cardinals, bishops and priests would be theologically honest. This would be ethical.
With the irrational interpretation of Vatican Council II, Pope Leo creates schism with the Church Fathers, the Apostles and the popes of the Middle Ages, and then tries to force this version of the Council upon the SSPX with the threat of being labeled schismatic. This is political and not Catholic.
From the secular point of view, a judge could note that:-
1. Pope Leo and Cardinal Fernandez interpret Vatican Council II irrationally and not rationally by confusing implicit cases of LG 8, 14, 16 etc as being explicit exceptions for the dogma extra ecclesiam nulla salus, the Athanasius Creed, the Nicene Creed, the exclusivist ecclesiology of the Roman Missal, the rational interpretation of all the Catechisms etc.
2. When Pope Leo and Cardinal Fernandez interpret Vatican Council II rationally they would automatically be affirming Feeneyite extra ecclesiam nulla salus. So as traditionalists, a legal Decree of Prohibitions could be issued against them as has been issued against the Slaves of the Immaculate Heart of Mary at the St. Benedict Center. So by interpreting Vatican Council II irrationally and so not having exceptions for the dogma EENS, they avoid this Decree.
1. This is dishonesty. Confusing what is invisible as being visible.
2. It is dishonesty, when Vatican Council II is interpreted unethically to avoid the Decree of Prohibitions charge.
3. It is schism when they do not affirm the Athanasius Creed etc with no exceptions. This Creed is not contradicted by Vatican Council II, rational.
4.With Vatican Council II irrational being a break with the traditional interpretation of the Nicene Creed, Cardinal Fernandez is in schism. Canonically he is expected to affirm all de fide teachings to be the Prefect of the Dicastery for the Doctrine of the Faith and be allowed to offer Holy Mass.
