The European Court of “Human Rights” (irony alert) has ruled in favour of the desecration of consecrated hosts (LeSalonBeige.fr, November 30).
It rejected an action brought by the Asociación de Abogados Cristianos, against the Spanish regime, claiming that there was nothing arbitrary in the Spanish judges' decision that the desecration did not constitute a crime.
The plaintiffs had brought a case against Abel Azcona, 35, who posed naked with 242 consecrated hosts in a disused church in Pamplona in 2015. He had picked them up at Novus Ordo Eucharists.
Azcona's performance was supported and financed by the city of Pamplona. The man has a history of mental problems, homosexual prostitution, drug use, petty crime and has been arrested several times for exhibitionism.
Much of Azcona's “work” consists of presenting himself naked and offering homosexual contact to viewers.
Unsurprisingly, the regime celebrates him as an “artist.”

Por un lado, el art. 524 castiga con la pena de prisión de seis meses a un año, o multa de 12 a 24 meses al «que en templo, lugar destinado al culto o en ceremonias religiosas, ejecutare actos de profanación en ofensa de los sentimientos religiosos legalmente tutelados».

Por “profanar” cabe entender tratar un objeto religioso o lugar sin el debido respeto o aplicarlo a usos profanos, exigiéndose, en todo caso, ofensa a los sentimientos religiosos.

El art. 524 fue objeto de modificación a través de la LO 15/2003, de 25 de noviembre, (vigente desde 1 de octubre de 2004) por la que se aumentó la pena de multa impuesta en sustitución de la de prisión

The art. 524 was modified through LO 15/2003, of November 25, (in force since October 1, 2004) by which the fine imposed was increased to replace the prison sentence.

Probably this artist did not profane inside a temple, did not do it in a religious ceremony, or did not harm a legal protected religious feeling. Or most likely the harmful intention was denied. Or maybe the hosts were told to be not consecrated (no proof can be presented). You know any lawyer knows how to get away with this.
