last will and testament.

RIP Fr Daniel & Fr Carl.

Tombstone of Julia O'Leary :

The Celtic cross raise o're me,
and the ivy round it twine.
it will tell of the land that bore me and her ancient faith that was mine.
and as struggling here I found it,
misunderstood and 'lone,
My heart grew fonder around it
like the ivy round that Stone.

Concerning wills: regardless of how little we have, someone will have to sort through our things and funds on hand in the bank, and someone will have to file and pay our taxes. Without a will, someone will have to open a small-estate administration to have the authority to do these things and to distribute any personal property we may have (cars, gifts, books, etc.). If we die in a plane crash or car accident, any insurance payout (or legal settlement) will be payable to our estate, and, without a will, it will be up to the State to determine who gets the funds.
Concerning the durable power of attorney for healthcare: Hospitals and doctors will not give any information to anyone without a HIPAA release or a durable power of attorney for healthcare, with the possible exception of immediate family members, and they will not accept decisions from anyone without the durable power of attorney for healthcare, with, again, the possible exception of immediate family members. If we want to ensure that the morally-correct decisions are made for us when we are unable to make decisions, we must take care of things now.
Resources:
State-specific forms for wills are available online for free or at very low cost. I have had good luck with
uslegalforms.com
and
legalzoom.com
, but there are other options.
Every State that I have checked has semi-official forms for the durable power of attorney for healthcare online for free.
For both of these forms, you should consult an attorney if you need help.
Custody and maintenance of these documents:

Both wills and durable powers of attorney for healthcare are State-specific documents; this means that you must re-do them every time you move to a different State.
Finally, please understand that these documents, although unpleasant to deal with, will give us peace of mind, knowing that things are taken care of, and that we will be relieving some future confrere or superior of significant burdens by making provision for our affairs now. Memento mori!
