If Quo primum tempore applies they do not have to ask for the right and the perennial privilege they have (ensuing also from the antiquity of the Roman rite as the liturgical custom of the Church). If Traditionis Custodes is deemed valid and legitimate then if they recognize it - submitting the request for the use - how can they later say: we are denied so we will nevertheless use it?

True, the Pope himself isn't banning it, but he is giving the bishops the ability to do so and the Pope isn't going to stop them. So he can blame them, and they can blame him for giving them the chance to do so.

Not all bishops are prohibiting the Latin Mass. If most bishops were traditionalists and supporters of the Latin Mass, Francis' motu proprio would be rendered all but irrelevant.
